Rick J. Lindsey, President and CEO of Prime Insurance Company, a specialty insurance carrier, announced another winning jury verdict in defense of their insured, SNM Logistics LLC, over an alleged trucking accident in Houston, Texas.
The claim arose from two brothers who alleged our insured’s tractor and flatbed trailer struck their car in Houston, Texas, causing them neck and low back injuries
which they claim required over $300,000 in medical bills. Despite Prime developing evidence that the accident never happened, and the medical care claimed was unnecessary, plaintiffs never offered to settle for less than $400,000 (driver) and $150,000 (passenger). Prime refused to settle, and at trial plaintiffs sought more than $300,000 for medical care plus multiples of these amounts for pain and suffering. The jury agreeing with Prime that the accident did not happen, gave SNM the defense verdict so that SNM owes nothing. As the winning party, SNM can recoup costs of suit that could total $5,000.
